Scibblenauts a beloved series that is on the DS and its latest entry on the Wii U has apparently found itself in the midst of a copyright infringement lawsuit.

According to Eurogame.net and a few other sites both Charles Schmidt creator of the internet video Keyboard Cat and Christopher Orlando Torres, creator of the Nyan Cat animated GIF have both filed lawsuits against Warner Bros and 5th Cell citing copyright infringement as their cause.

According to both men WB and 5th Cell used both their creations to "promote and market" their games.

Oddly enough both weren't trademarked till 2010 a year after the first Scribblnauts game came out something I am sure the WB and 5th Cell lawyers will bring to the courts attention.

Both WB and 5th Cell have not yet commented.

So what do you think does these two creators have a reasonable suit? Or do you think that WB and 5th Cell will walk away with this one? Tell us what you think in the comments below.
